Thailand's Election Commission will decide by end-August whether to prosecute 229 people, including 138 current senators, accused of manipulating the senate selection process through coordinated efforts to elect predetermined candidates.

The Election Commission office has clarified its handling of the ongoing senate selection case currently under review by all seven commissioners, who must decide whether to forward charges to court. The commission stated it is proceeding according to legal procedures, carefully examining all facts and evidence to cover every aspect, with a decision expected by the end of August 2025, followed by a vote.

The office emphasized that the commission is not an investigative body but rather reviews complaints based on gathered facts and evidence using independent, thorough, and impartial judgment, ensuring decisions rest solely on evidence and law. The commission asked the public to trust its process, which upholds principles of justice, impartiality, and evidence-based consideration.

The clarification comes amid intense scrutiny of the case, which is now in its final stage at the commission. The senate selection case is significant not only as a major political scandal but also affects the legislative branch and democratic development. During the senate selection process, there were widespread allegations of coordinated group efforts to get predetermined candidates elected, conducted openly and leaving extensive evidence, making prosecution unavoidable.

The commission is currently reviewing charges against 229 accused persons recommended for prosecution by the 26th investigation and interrogation subcommittee, including 138 current senators and 91 politicians and networks. The politicians range from cabinet ministers and MPs to national-level party figures suspected of planning and directing the scheme for personal gain.

Observers have identified three likely outcomes: full prosecution, no prosecution, or selective prosecution of certain individuals, with selective prosecution considered most likely. Ultimately, regardless of the commission's decision, it must clearly explain its reasoning to society, particularly if it declines to prosecute or prosecutes only some individuals, or risk losing the public confidence it has promised.
