BANGKOK — The Cabinet has approved draft regulations establishing a formal process for deporting foreign nationals who enter, work or conduct business in Thailand illegally, as well as those convicted of serious crimes.

Government spokesperson Ratchada Thanadirek said the Cabinet approved the draft Prime Minister's Office regulations on deportation during its meeting on Tuesday, following a proposal submitted by Deputy Prime Minister Pakorn Nilprapunt.

The regulations identify six categories of offences that may warrant deportation when authorities consider removal necessary to protect public order and public morality. They apply to foreign nationals who:

- Enter or remain in Thailand illegally; - Work in Thailand in violation of laws governing foreign employment; - Conduct business in Thailand in violation of the Foreign Business Act; - Forge official documents or use forged government documents; - Commit an offence carrying a prison sentence of three years or more; or - Act as a principal, instigator or supporter of any of the above offences.

The proposal follows a Cabinet resolution on 16 June appointing Pakorn to coordinate with relevant agencies on improving laws, regulations and procedures concerning immigration. The review was intended to speed up the removal of foreign nationals who commit crimes or enter the country illegally.

Thailand currently has no unified administrative regulations governing deportation, requiring agencies to coordinate closely on individual cases. The new framework is intended to make deportation procedures faster and more efficient.

Under the draft regulations, the director-general of the Department of Corrections must provide the Interior Ministry permanent secretary, or a designated official, with the names, nationalities, case files and other relevant information concerning foreign prisoners before their release. The permanent secretary or designated official must then report the case to the interior minister, who will consider issuing a deportation order without delay.

The Interior Ministry will be responsible for returning the person to their country of nationality. Where a person's nationality cannot be established, they may be deported to the country where they say they last lived before entering Thailand.

A person may also be transferred to another country where they are not a citizen, or to an international organisation, if a request is submitted through diplomatic channels. The receiving country or organisation must agree to cover all expenses associated with the person's care and removal, while the person facing deportation must also provide written consent to the transfer.

A fire at a beer hall in Ladprao has killed at least 30 people and injured dozens, evoking memories of similar past disasters that have been allowed to repeat. Previous tragedies have ended only in investigations and compensation without meaningful legal reform to match modern standards and actual practices, particularly regarding venue zoning laws. A major loophole is the misclassification of businesses: many operators register as "music restaurants" when they actually operate as pubs or entertainment venues with dancing, loud music, and late hours—escaping stricter safety standards through this legal gray area. Building and materials standards also remain inadequate; many establishments still use flammable materials, lack proper fire exits and emergency doors, and fire prevention systems are not regularly inspected. The article calls for updated regulations covering all hybrid restaurant-pub operations of any size, mandatory annual inspections, and steeper penalties for violations. It also urges mandatory liability insurance for high-capacity venues to ensure victims receive rapid compensation without years of civil litigation. Above all, laws must be genuinely enforced; good laws mean nothing if applied only ceremonially, leaving the door open for repeated tragedies. The article demands that the Interior Ministry, Bangkok authorities, and all relevant agencies conduct nationwide inspections of similar establishments and urgently push through legal reforms. On July 14, 2025, Chitpong Kattapong, also known as 'Nutty,' a former candidate for the Phayathai District city council, went live on social media to explain his presence at the fire scene. He stated that he was wearing tactical gear that day because he had been participating in an activity in the Rangsit area. "I have received training in high-rise buildings, large structures, and emergency response from Bangkok's disaster prevention and mitigation office. Since I've been trained, I wanted to give back and use my knowledge to help others," Kattapong explained. He noted that he had initially removed the gear when leaving the airsoft arena but put it back on for safety reasons before arriving at the fire scene.

When asked about the black radio visible in photos, Kattapong confirmed he had received training in radio communications and holds a personal radio code (Phraya 413) as a member of the Phayathai civil defense unit. He emphasized that his ID cards, including his reserve officer card, are genuine and not counterfeit. He obtained his reserve officer rank through completing three years of Reserve Officers' Training and holding a high school diploma or vocational certificate. He clarified that while he holds this rank, he receives no salary and is not a government employee, but can be called upon to assist during emergencies.

A deadly fire at an entertainment venue in Bangkok's Lat Phrao area has exposed a wider problem in Thailand's regulatory system: many businesses licensed as restaurants now operate much like pubs, bars or entertainment venues, yet remain subject to a different set of rules and a lower level of scrutiny.

Authorities must examine whether the law allows operators to choose licences that are easier and cheaper to obtain, even when the way their businesses operate creates risks similar to those found in licensed entertainment venues.

Under Thai law, restaurants and entertainment venues are treated as separate types of business. Restaurants are regulated under the Public Health Act of 1992, with licences issued by local authorities including the Bangkok Metropolitan Administration, municipalities and subdistrict administrative organisations. Operators must show that their premises meet standards covering sanitation, cleanliness, kitchen facilities, toilets, waste management and building requirements.

Entertainment venues fall under the Entertainment Place Act of 1966. Businesses that operate primarily for entertainment, including venues serving alcohol, hosting live music or performances, or providing space for dancing, must obtain an entertainment venue licence before opening. This process involves several agencies—administrative officials, police, city planning authorities and safety inspectors—and venues are restricted to officially designated areas.

As a result, opening a licensed entertainment venue is far more complicated than opening a restaurant. The rules are stricter, the locations are more limited and the approval process is more demanding.

Many restaurant venues have changed considerably in recent years. They now feature stages, live bands, DJs, large sound systems and elaborate lighting, with alcohol often accounting for much of their revenue and customers staying late into the night. In practice, these venues look and operate much like pubs or bars, yet on paper they remain restaurants.

The appeal is straightforward: restaurant licences are generally simpler to obtain, allow businesses to operate in more locations, avoid entertainment-zone restrictions and reduce administrative costs. Operators may then apply separately for permission to use amplified sound and obtain licences to sell alcohol. However, the system does not always bring those approvals together or assess what the business has become as a whole, creating a regulatory blind spot.
