Police found five other Myanmar nationals crammed into the rear of the vehicle, including two men who were allegedly hiding behind the back seats. The five passengers were unable to communicate in Thai and could not produce passports or any immigration documents. During questioning, the driver and front-seat passenger allegedly admitted they had been hired by a man known only as Joe to transport the five migrants. Police said the group had crossed into Thailand through a natural border crossing in Kanchanaburi before being taken to a temporary stop in Sam Phran district, Nakhon Pathom. The pair allegedly told investigators they were transporting the migrants to Samut Prakan for 900 baht per person. The two men were charged with helping illegal migrants enter or remain in Thailand unlawfully. Under Section 64 of Thailand’s Immigration Act, knowingly sheltering, concealing or otherwise assisting a person who has entered the country illegally to avoid arrest carries a maximum penalty of five years’ imprisonment, a fine of up to 50,000 baht, or both. The five passengers were charged with being in Thailand without permission. Under Section 81 of Thailand’s Immigration Act, the offence carries a maximum penalty of two years’ imprisonment, a fine of up to 20,000 baht, or both. Elsewhere, earlier in January, highway police arrested a pickup truck driver and uncovered 25 undocumented Myanmar migrant workers after a late-night pursuit on a major road in Nakhon Sawan. Regarding fuel price fluctuations and shortages in March 2025 stemming from hoarding that harmed the public and businesses nationwide, the TCC worked with multiple agencies from April to July 2025 to inspect fuel depots and monitor trader behavior across provinces. These investigations yielded evidence leading to two cases now under review:

1) A fuel storage facility in Ang Thong Province selling fuel at excessively high prices, constituting unfair pricing and anti-competitive conduct in violation of the Trade Competition Act B.E. 2560, Sections 50(1) and/or 57(1), carrying criminal penalties.

2) A major fuel distributor restricting fuel allocation to wholesale distributors (jobbers) while claiming to reserve supplies for its branded service stations—stations that received no increased allocation. This forced independent dealers to source from the sole remaining refinery at higher prices and longer wait times, harming businesses and the public. This conduct constitutes unfair conditions, unjustified supply restrictions, and anti-competitive practices under the Trade Competition Act, Sections 50(2)(3) and 57(1)(2)(3), carrying criminal penalties.

Associate Professor Sutham Yainai, vice-chairman of the TCC, added that the commission is actively overseeing competition in four major business sectors: digital platforms, modern trade (wholesale and retail), ride-hailing services, and online accommodation platforms (OTA). Subcommittees have been established to study, analyze, and recommend oversight guidelines for each sector, with findings due by the fourth quarter. The TCC is also refining conduct guidelines to clearly address evolving business practices.

One major problem the department is investigating with the Land Department is foreign nationals illegally holding real estate and land through shell companies. Under land law, foreigners cannot directly own such property but instead use nominee structures, repeatedly changing directors and shareholders to evade the law rather than conducting legal transactions. Initial inspections have found companies where foreigners hold no more than 49% of shares—listed as Thai—a structure that may constitute nominee use or allow Thai nationals to hold shares on behalf of foreigners to acquire property.

To ensure proper understanding, starting August 1, 2026, the department will add a disclaimer to all shareholder copies stating: "The registrar accepted this shareholder list as submitted by company directors. Providing a copy is not a certification of the authenticity of the shareholding status shown. Determining who is a shareholder requires checking the shareholder register held by the company, which is presumed under law to be accurate evidence—not a copy held by the registrar." This ensures all agencies and the public understand the legal requirements and apply correct procedures.

Poonpong said the department's approach aligns with a Supreme Administrative Court judgment establishing that registrars only receive and store documents as legally required and do not certify shareholding status or rights. Shareholder verification must come from the register the company itself maintains. Under law, the department receives shareholder lists from company directors for filing and public inspection under the Civil and Commercial Code Section 1020.
