Thai Justice Ministry Says Overseas Online Gambling Claims Are Fake
Thailand’s Ministry of Justice has dismissed as false the claim that Thais can legally operate online gambling websites if they are based overseas and hold foreign licences. Citing the Penal Code and the Gambling Act, the Ministry stressed that Thai law applies to any gambling activity linked to the kingdom, irrespective of where it is run or licensed. The clarification was posted on the Ministry’s Facebook page on October 7, 2026.
The Ministry cited the Penal Code, noting that Thai criminal law applies to offenses committed wholly or partly within Thailand, or where the effects of the offense occur in Thailand. It also referred to the Gambling Act BE 2478, which defines gambling offenses and requires a case‑by‑case assessment of the facts and legal provisions. Simply having a foreign licence or operating outside Thailand does not automatically exempt a Thai national from liability. Therefore, the claim that Thais can legally run online gambling businesses abroad is unfounded.
