Administrative Court Warns NBTC Over Misrepresentation of Ruling

The Administrative Court has warned the National Broadcasting and Telecommunications Commission (NBTC) against distorting a court order in the case of Clinical Professor Dr. Sorin Boonbai Chai Phrueksa, stating that publishing only partial excerpts of the ruling without complete context may cause public misunderstanding.

On September 4, 2026, the Administrative Court Office clarified its position regarding NBTC press release No. 85/2569 dated September 3, 2026, which was distributed on the NBTC website and online media. The court explained that the statements appearing in the NBTC press release represent only selected portions of Administrative Court Order No. 952/2569, in which the Supreme Administrative Court overturned a lower administrative court's decision and accepted Dr. Sorin's lawsuit challenging the NBTC Selection Committee's Resolution No. 1/2569 dated July 21, 2026.

After reviewing the press release, the Administrative Court Office found that sections 3, 4, and 5 containing statements beginning with "The Supreme Administrative Court stated that..." do not accurately reflect the court's actual ruling. The court noted that portions cited by NBTC regarding standing to sue under Section 42 of the Administrative Court Establishment and Procedure Act were merely claims presented in the plaintiff's appeal arguments, not the court's actual findings or reasoning on the disputed issues.

The Administrative Court Office stated that publishing only partial excerpts from court orders without complete and accurate context in a manner that may cause public misunderstanding of the court's ruling and reasoning constitutes a violation of law. The office announced it will take appropriate action in related matters and has informed the public accordingly.
