Thai Securities Regulator Sets Pooled Fund Pension Standards

On September 7, the Securities and Exchange Commission released guidelines for establishing regulations governing pooled-type multi-employer provident funds. The guidelines are intended for fund committees, employers, employees, fund management companies, and other stakeholders to use when drafting or updating fund regulations to ensure clarity and better protect member rights.

Under the 1987 Provident Fund Act, fund regulations must meet only minimum requirements, and current registration procedures do not mandate a standard format for submission. This has resulted in fund regulations varying widely in form and content. Pooled funds, which are typically established by management companies to serve multiple employers, often follow formats set by the management company with room for additional employer-defined conditions. As pooled funds continue to grow with increasing employer and employee participation, clearer provisions are needed to support broader participation and better protect member interests.

As the provident fund registrar, the commission considers it important to ensure pooled fund regulations are appropriate to each fund's nature and member protections. The commission has therefore developed and released guidelines for establishing multi-employer pooled-type provident fund regulations to help stakeholders adapt them appropriately while promoting clear, member-focused fund governance.

The commission also plans to promote and monitor implementation of these guidelines by evaluating compliant funds and publicly identifying pooled funds that have adopted the framework, recognizing those prioritizing robust, appropriate fund regulations that serve member interests.
